  2. Important Note on Existing Patents, Production & Collaboration

    (Informational – Not Legal Advice)

    Digital board game systems and interactive gaming surfaces are not a completely new field. Various patents and products related to electronic game boards and interactive floors have existed since at least the 1990s and 2000s. Many of those early patents are now expired and form part of the public domain, while some more recent patents may still be active in certain countries.

    This means that:

    • The general idea of “a digital game board” or “an interactive floor” is not empty territory, but

    • It is still possible to design, build, and commercialize new products in this area, provided they do not infringe on active patent claims and instead rely on:

      • Expired prior art (which is free to use), and

      • Genuinely new, non-obvious technical implementations.

    My concepts for the Digital Board Game Platform, Digital Board Game Carpet, and the wider ecosystem (tabletop device + carpet + online cross-device platform + AI coaching + AR/VR + smart wearables) are intended to stand on top of older prior art while adding new combinations, new architectures, and new technical mechanisms. Examples include, among other things:

    • The specific way tabletop, carpet, cloud platform, AR/VR, and smart wearables are integrated into one ecosystem.

    • Particular hardware and sensor arrangements for the carpet and tabletop device.

    • AI coaching, analytics, and cross-device synchronization workflows designed for both entertainment and education/rehab use cases.

    Whether particular aspects of these Systems are patentable, and whether a specific hardware or software implementation has “freedom to operate” in a given country, depends on a detailed legal and technical analysis of existing patents and products. That kind of assessment can only be done by a qualified patent attorney or patent agent.

    In practical terms:

    • It should be possible to produce and commercialize hardware and software based on these concepts, by:

      • Designing around existing active patents where necessary;

      • Using expired prior art as a technical base;

      • Focusing on novel structures and implementations that are clearly distinguishable.

    • Collaboration with existing patent owners and technology holders is also possible, for example through:

      • Licensing agreements (paying royalties to use specific protected technologies);

      • Joint development or joint ventures (combining their protected technology with my ecosystem concepts);

      • Future cross-licensing arrangements, if and when my own patents are granted.

    • I reserve the right to seek patent protection for new and non-obvious aspects of the Systems, including but not limited to:

      • Unique hardware architectures (for both tabletop device and carpet);

      • AI-driven coaching, analytics and adaptation pipelines;

      • Cross-device and cross-environment synchronization of physical/digital play (tabletop, carpet, AR/VR, wearables) as defined in my more detailed technical descriptions.

    This explanatory note is intended to clarify the realistic context: there is existing prior art in the field, but there remains significant room for innovation, ethical collaboration, licensing, and new patent filings around the specific ecosystem, architectures, and implementations I have created.

    This section is informational only and does not constitute legal advice, a patentability opinion, or a freedom-to-operate opinion. For any concrete legal steps (such as filing patent applications, entering licensing agreements, or assessing infringement risks), I will consult a qualified patent professional in the relevant jurisdictions.

  3. Practical Note on the Simple Dedicated Game Board Device
    In practice, nothing in current law prevents the development of a simple dedicated digital game board: a flat touchscreen device with built-in computing power, speakers, an operating system, and support for external devices (for example, smartphones used as private “hands” for card games). Hardware of this type is conceptually similar to a tablet or all-in-one touch computer placed on a table, and such devices are widely manufactured and sold worldwide.

    At the same time, there are existing and historical patents in the general field of digital game boards, interactive tables, and interactive floors. These patents typically protect specific technical implementations (for example, particular sensor architectures, tracking mechanisms, or interaction methods), and many older patents have already expired. The broad idea of “a touchscreen device that runs multiple digital board and card games” is long known and cannot be owned in a general way.

    My intention is to implement the Digital Board Game Platform and any simple dedicated game board in a way that respects existing intellectual property: avoiding the copying of protected mechanisms, trade dress, code, or trademarks, and focusing on my own original technical architectures, UX, and ecosystem design. Questions of detailed patentability or freedom-to-operate for any specific hardware configuration will, when relevant, be evaluated in cooperation with a qualified patent attorney, and I remain open to licensing or collaboration with existing patent holders where this creates mutual value.

  4. Development, Patent & Collaboration Intent for the Dedicated Digital Game Board
    In addition to the broader ecosystem described in this document, I explicitly intend to design, develop, and bring to market a dedicated digital game board device: a standalone touchscreen-based board with integrated computing power, operating system, audio, connectivity, and support for external devices (such as smartphones used as private controllers, tablets, smart TVs, and AR/VR headsets). Wherever the specific technical implementation of this device is found to be novel and non-obvious in view of existing prior art, I reserve the right to seek patent protection for those aspects. At the same time, I am fully open to ethical collaboration and licensing relationships with existing patent holders and industry partners, in order to develop, co-develop, manufacture, and distribute such dedicated digital game boards in a way that respects all valid intellectual property rights and creates mutual value for all parties involved.

  1. Note: I deleted the earlier images that included a well-known commercial board game. I’m not connected to or licensed by that brand. The idea I’m sharing is my own digital board-game platform, and the new visuals are generic examples just to illustrate the concept.
